SC allows mining operations in Nueva Vizcaya, Quirino

THE SUPREME Court has dismissed a petition by an environmental group that sought to stop an Australian mining firm from operating in the provinces of Nueva Vizcaya and Quirino.

With the high court ruling, Climax-Arimco Mining Corporation (CAMC) can conduct its mining activities in these areas despite claims by members of the Didipio Earth-Saver's Multi-Purpose Association Inc. (DESAMA) that the firm violated Republic Act No. 7942 or the Philippine Mining Act.

The group noted that the law did not allow firms to operate in mining areas without paying just compensation to affected residents.

In a 39-page decision, the high court First Division said Section 76 of RA 7942 allows mining companies to enter private lands to conduct mining activities.

The high court explained that the use of private lands was valid if it would be for public use.

"[The] mining industry plays a pivotal role in the economic development of the country and is [a] vital tool in the government's thrust of accelerated recovery...Irrefragably, mining is an industry, which is of public benefit," the high court said in the decision penned by Associate Justice Minita Chico-Nazario.

The high court also clarified that negotiations for just compensation could be done through the panel of arbitrators from the Mines and Geosciences Bureau (MGB).

Members of the group sought a high court ruling for fear that residents would be displaced by the mining activities.

On February last year, the Philippine Mining Act of 1995 (RA 7942) and its Implementing Rules and Regulations (IRR) were declared constitutional by the high court after it upheld its Dec. 1, 2004 decision.

The 246-page resolution penned by now Chief Justice Artemio V. Panganiban maintained that all conceivable aspects of the case -- factual, constitutional, legal, philosophical, technical, financial, ecological, environmental, and technological -- have been extensively taken up and addressed during its lengthy and purposeful debates and deliberations.
